1. How is his normal performance? If this is the first time, you may consider giving him a break. But if he always shows no respect to the company's rules, you'd better make use of this incidence to kick him out immediately.
2. Consult the legal department of your company and assure that you can kick him out with no legal complication. Consult HR for any other alternatives, like internal punishment, fine, etc.
3. Talk to him and ask for the reason. If the reason is sound you may consider something softer.
4. Whatever decision you make, make it public and defend yourself when your decision is challenged. Do to attempt to cover it up secretly.
