Navy Sets Aside Rape Case Conviction

内容:Washington. Aug. 11 (AP)—The navy today set aside the conviction of Marine Cpl. William G. Pierson of Sumter, S.C., in a rape case which touched off anti-American demonstrations in north China last winter. The conviction of private first class Warren T. Pritchard of Petaluma, Calif., as an accessory in the alleged rape also was set aside.

The navy announced that Secretary Forrestal acted in both cases on the ground the evidence was insufficient.

Senator Olin D. Johnston (D.,S.C.) had disclosed in June that the navy judge advocate general, after a review, had concluded the charge was unwarranted and recommended that the convictions be set aside. A few days later Dr. Hu Shih, former Chinese ambassador to the United States and now president of National Peking university, told reporters in Peiping that the case was being "watched anxiously by the whole country as a test of American justice" and expressed hope Forrestal(注:当时的海军部长,一个月后的国防部长) would not approve the recommendations for dismissal.

The navy announced today cited evidence that the Chinese girl, Shen Chung,19, had been in Pierson's company for about three hours on a polo field near a heavily traveled street in Peiping, that she did not prefer charges until the following day, and that neither a Chinese nor an American physician who examined her found any evidence of physical violence.
